What Are The Legal Ramifications of Prop 8?

If Proposition 8 passes, there will be NO legal ramifications, other than the ceasing of homosexual marriages in California, and whatever is determined must be done about those marriages which have been performed already.

If Proposition 8 is not passed, the legal ramifications will be closely intertwined with the social ramifications, but there are other other legal issues that must also be addressed.

In March 2007, the Ninth Circuit Court of Appeals, in San Francisco, ruled that "it's OK to Censor the Terms 'Natural Family,' 'Marriage' and 'Family Values'... The City of Oakland claimed that references to the "natural family, marriage and family values" constituted hate speech which is scary to city workers." If Prop.8 is struck down, this trend will continue and so-called 'hate-crime' laws will bar married heterosexual couples from referring to themselves in a traditional manner.

Of special concern to parents is the legal duty of the public school system to teach marriage as defined by the California State Constitution. If a redefinition is allowed, this will result in California schools teaching all children that homosexual relationships are equal to heterosexual relationships - an opinion that is not shared by a majority of Californians, and a matter to better be discussed by families, themselves, as it is determined by personal, religious, and other factors.

Another venue of concern to those in opposition to gay marriage is the trend of courts ruling in favor of sexual rights over and above any other considerations, including religious beliefs that have existed for millenia!

No person or organization ought to be caused by force to perform any act that is in violation of his or her personal morals or religious beliefs.
